This case raises some of the most difficult legal questions I’ve covered: how the law defines criminal responsibility when a defendant’s mental state is genuinely in dispute, and how rare, severe conditions like postpartum psychosis get litigated in a courtroom built around legal standards, not clinical ones.
Clancy has not disputed her role in her children’s deaths. Her defense is built entirely around an insanity plea, and this week the court already made a significant pretrial ruling limiting what testimony the defense can present about postpartum psychosis and postpartum depression. That ruling alone could shape how this entire trial unfolds.
I’ll be breaking down the legal strategy on both sides, what the jury will actually need to find to reach a verdict, and what this case could mean for how insanity defenses involving postpartum mental health conditions are handled going forward.
