FACTS: Ang mga police officers ng QCPD Anti-Terrorism Operations Team ay nagsagawa ng implementation of Warrant of Arrest laban sa ilang indibidwal, kabilang ang isang taong kilala lamang sa alyas na "Ali."

Matapos ang intelligence gathering at surveillance, inaresto nila si Allan Almoite, dahil sa kanilang 𝐠𝐨𝐨𝐝-𝐟𝐚𝐢𝐭𝐡 𝐛𝐞𝐥𝐢𝐞𝐟 na siya ang taong tinutukoy sa warrant. Nakarekober din ang iba't ibang explosives sa kanyang bahay.

Gayunman, kalaunan ay naglabas ang RTC ng kautusan na palayain si Almoite matapos nitong mapag-alamang hindi siya ang "Ali" na tinutukoy sa kidnapping case.

Dahil dito, naghain si Almoite ng administrative complaint laban sa mga police officers para sa 𝐎𝐩𝐩𝐫𝐞𝐬𝐬𝐢𝐨𝐧, 𝐆𝐫𝐚𝐯𝐞 𝐌𝐢𝐬𝐜𝐨𝐧𝐝𝐮𝐜𝐭, 𝐚𝐭 𝐂𝐨𝐧𝐝𝐮𝐜𝐭 𝐔𝐧𝐛𝐞𝐜𝐨𝐦𝐢𝐧𝐠 𝐨𝐟 𝐚 𝐏𝐨𝐥𝐢𝐜𝐞 𝐎𝐟𝐟𝐢𝐜𝐞𝐫. Iginiit din niya na siya ay tinortyur habang nakakulong.

Noong una, ang Deputy Ombudsman ay nagrekomenda lamang ng tatlong (3) buwang suspension dahil sa Simple Misconduct. Ngunit kalaunan, binago ito ng Ombudsman, idineklarang guilty ang mga pulis sa Grave Misconduct, at ipinataw ang parusang 𝐝𝐢𝐬𝐦𝐢𝐬𝐬𝐚𝐥 𝐟𝐫𝐨𝐦 𝐭𝐡𝐞 𝐬𝐞𝐫𝐯𝐢𝐜𝐞.

Inapela ng mga pulis ang desisyon sa CA, na nagbaligtad sa desisyon ng Ombudsman at pinawalang-sala sila. Dahil dito, umakyat ang Ombudsman sa Supreme Court.

Napawalang sala ang mga police officers.

Ayon sa Korte, hindi napatunayan sa pamamagitan ng substantial evidence ang Grave Misconduct dahil walang ebidensya na ang mga police officers ay kumilos nang may:

- Corruption (katiwalian);
- Clear intent to violate the law (malinaw na layuning labagin ang batas); o
- Flagrant disregard of established rules (hayagang pagwawalang-bahala sa umiiral na mga alituntunin).

Ang tatlong elementong ito ay kinakailangang mapatunayan bago masabing ang misconduct ay grave.

Napag-alaman din ng Korte na ang mga police officers ay kumilos nang may 𝐠𝐨𝐨𝐝 𝐟𝐚𝐢𝐭𝐡, batay sa kanilang intelligence reports, surveillance, cartographic sketch, at iba pang impormasyong nag-uugnay kay Almoite sa alyas na "Ali."

Sa kanilang tapat na paniniwala, si Almoite ang taong tinutukoy sa warrant at wala silang masamang motibo sa pag-aresto sa kanya.

Dagdag pa rito, sinabi ng Korte na kahit nagkamali sila sa pagkakakilanlan kay Almoite, ang pagkakamaling iyon ay hindi awtomatikong nangangahulugan ng misconduct, sapagkat ang kanilang pagkilos ay nakabatay sa 𝐫𝐞𝐚𝐬𝐨𝐧𝐚𝐛𝐥𝐞 𝐠𝐫𝐨𝐮𝐧𝐝𝐬 𝐚𝐭 𝐠𝐢𝐧𝐚𝐰𝐚 𝐢𝐧 𝐠𝐨𝐨𝐝 𝐟𝐚𝐢𝐭𝐡.

Tungkol naman sa alegasyon ng torture, bagama't may medical findings ang Commission on Human Rights (CHR) na nagpapakitang may mga sugat si Almoite, hindi niya partikular na natukoy ang mga respondent bilang mga taong nanakit sa kanya.

Binigyang-diin ng Korte na ang simpleng alegasyon lamang, kung walang competent evidence, ay hindi sapat upang magpatunay ng administrative liability.

Sumakses ang appeal. Reinstated, with backwages. Yung retired na, may backwages at retirement benefits.
