This response actually gave us an important distinction.
The Commission told me that selling non-prescription teeth-whitening products is NOT considered the practice of dentistry.
But they also said that if someone is administering the whitening products, they may be considered to be practicing dentistry.
That’s where the self-application question comes in.
With the model I teach, the provider is not applying anything inside the client’s mouth. The client applies and removes the whitening product themselves.
So the big unanswered question is:
Does providing the product, LED, space and instructions while the client performs everything themselves count as “administering” whitening?
Washington did not directly answer that.
Their statute also says you need a dental license if you “offer or undertake by any means or methods” to remove stains from teeth.
That wording makes me cautious, especially when it comes to advertising.
If you are truly offering self-application, your marketing should clearly describe that model and avoid language that makes it sound like YOU are personally whitening teeth or removing stains.
The Commission also told me they are not aware of any specific statutes or rules regarding LED lights.
So for now:
🟠WASHINGTON — Self-application is not clearly prohibited, but it is also not clearly approved.
Retail sale of non-prescription whitening products appears to be allowed, but the line between providing a self-application experience and “administering” whitening still needs clarification.
That’s exactly why I’m reading these responses carefully instead of turning every unclear answer into a green light.

"CONSENT FORMS" do not supersede the LAW.
A client cannot simply "consent" to you doing something you are not legally allowed to do.
That would be like, "I know I don't have a medical license, but my client said I could perform her tummy tuck and lipo."
A signature is not a loophole.
